By accessing or using Weladee Form (the "Service"), operated by Frontware International Co., Ltd. ("Frontware," "We," "Us," or "Our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Frontware International Co., Ltd. is the sole owner and distributor of Weladee Form Service. All rights to the Service, including intellectual property rights, are owned by Frontware.

3. DESCRIPTION OF SERVICE

Weladee Form is an online form creation and response collection platform that allows users to:

Create custom forms with various question types
Collect responses from form respondents
Manage and export collected data
Customize form appearance with themes

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

4. USER RESPONSIBILITIES AND PDPA COMPLIANCE

4.1 You Are the Data Controller

When you create a form and collect personal data from respondents, you act as the Data Controller under Thailand's Personal Data Protection Act B.E. 2562 (2019) ("PDPA"). Frontware International Co., Ltd. acts solely as a Data Processor, processing data only according to your instructions.

4.2 Your PDPA Obligations

YOU ARE ENTIRELY RESPONSIBLE for ensuring your use of the Service complies with the PDPA and all applicable data protection laws. This includes, but is not limited to:

Privacy Notices: Providing clear privacy notices to your respondents before collecting their personal data
Consent: Obtaining valid, informed consent from respondents before collecting their personal data
Lawful Basis: Ensuring you have a lawful basis for processing personal data under the PDPA
Data Minimization: Collecting only the personal data that is necessary for your stated purpose
Purpose Specification: Clearly communicating the specific purpose(s) for data collection
Data Subject Rights: Respecting respondents' rights to access, correct, delete, or object to processing of their data
Data Security: Implementing appropriate security measures to protect collected data
Data Retention: Retaining personal data only for as long as necessary
Cross-Border Transfers: Ensuring compliance when transferring data outside Thailand
Sensitive Data: Obtaining explicit consent before collecting sensitive personal data

4.3 You Acknowledge and Agree

By using the Service, you acknowledge and agree that:

Frontware is NOT responsible for your compliance with the PDPA or any data protection laws
You are solely responsible for all data collection activities conducted through your forms
Frontware provides only the technical platform and has no control over what data you collect or how you use it
Any violation of PDPA or other data protection laws is entirely your responsibility
You will indemnify Frontware against any claims arising from your data collection practices

5. PROHIBITED USES

You may NOT use the Service for any of the following purposes:

Illegal Activities: Any purpose that violates Thai laws or regulations
Fraud: Collecting data through deception, misrepresentation, or fraudulent means
Spam: Sending unsolicited commercial communications or spam
Harassment: Harassing, abusing, or harming individuals
Malicious Content: Distributing malware, viruses, or harmful code
Intellectual Property Infringement: Infringing on trademarks, copyrights, or other IP rights
Defamation: Publishing defamatory, libelous, or false statements
Discrimination: Collecting data for discriminatory purposes
Adult Content: Collecting or distributing explicit sexual content
Political Manipulation: Using forms for political propaganda or manipulation
Phishing: Creating forms designed to steal credentials or personal information

We reserve the right to immediately suspend or terminate your account if you violate these prohibitions.

6. USER CONTENT AND DATA RESPONSIBILITY

6.1 You Own Your Content

You retain ownership of all content you create using the Service, including form text, questions, and configurations. However, you grant Frontware a license to store, process, and display your content solely to provide the Service.

6.2 You Are Responsible for Your Content

YOU ARE ENTIRELY RESPONSIBLE for:

All content in your forms
All personal data you collect from respondents
Ensuring your content complies with all applicable laws
Obtaining all necessary consents and permissions
Responding to data subject requests (access, deletion, etc.)
Any claims arising from your content or data collection

6.3 Frontware Has No Obligation to Monitor

While we may review forms for compliance, Frontware has NO obligation to monitor your content or activities. We are not responsible for any content you create or data you collect.

7. INTELLECTUAL PROPERTY

7.1 Frontware's Intellectual Property

The Service, including all software, designs, text, graphics, logos, and code, is owned by Frontware International Co., Ltd. and protected by Thai copyright laws and international treaties.

You may NOT:

Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble the Service
Use Frontware's trademarks without written permission
Remove any proprietary notices from the Service

7.2 Feedback

If you provide feedback or suggestions about the Service, you grant Frontware a perpetual, royalty-free license to use such feedback without any obligation to compensate you.

8. USER ACCOUNTS AND SECURITY

8.1 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying Frontware immediately of unauthorized access

8.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older.

9. PAID SERVICES AND BILLING

9.1 Fees

Certain features of the Service may require payment of fees. All fees are non-refundable unless otherwise specified.

9.2 Billing

You agree to pay all charges incurred under your account. Frontware reserves the right to change fees at any time with 30 days notice.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY: The Service may not meet your requirements
FITNESS FOR PURPOSE: The Service may not be suitable for your intended use
NON-INFRINGEMENT: We do not guarantee the Service will not infringe third-party rights
AVAILABILITY: The Service may be interrupted or unavailable
ACCURACY: We do not guarantee error-free operation
SECURITY: No system is completely secure; we cannot guarantee absolute security

11. LIMITATION OF LIABILITY

11.1 MAXIMUM LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY THAI LAW, FRONTWARE INTERNATIONAL CO., LTD.'S TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO FRONTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

11.2 EXCLUDED DAMAGES

IN NO EVENT SHALL FRONTWARE BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
LOST PROFITS OR REVENUE
DATA LOSS OR CORRUPTION
BUSINESS INTERRUPTION
PDPA VIOLATIONS OR PENALTIES (YOUR RESPONSIBILITY)
THIRD-PARTY CLAIMS ARISING FROM YOUR USE
DAMAGES EXCEEDING THE APPLICABLE FEES PAID

11.3 Data Protection Liability

YOU AGREE THAT FRONTWARE IS NOT LIABLE for any PDPA violations, data breaches, or penalties arising from your data collection activities. You are solely responsible for PDPA compliance.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Frontware International Co., Ltd., its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any law or regulation (including PDPA violations)
Your collection, use, or disclosure of personal data
Your content or forms
Claims by respondents or third parties

13. TERMINATION

13.1 Termination by You

You may terminate your account at any time by contacting us at [email protected].

13.2 Termination by Frontware

We may suspend or terminate your account immediately if:

You violate these Terms
You use the Service for illegal activities
You violate the PDPA or data protection laws
Your account poses a security risk
You engage in spam or fraudulent activities

13.3 Effect of Termination

Upon termination:

Your right to use the Service ends immediately
We may delete your data after 30 days
You remain liable for all obligations incurred before termination

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in Thai courts.

14.2 Dispute Resolution

14.3 Venue

Any legal proceedings shall be brought in the courts of Bangkok, Thailand.

15. MODIFICATIONS TO TERMS

We may modify these Terms at any time. Material changes will be notified via email or platform notice. Continued use after changes constitutes acceptance.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. WAIVER

Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Frontware International Co., Ltd. regarding the Service.

BY USING WELADEE FORM, YOU ACKNOWLEDGE THAT:

You have read, understood, and agree to these Terms
You understand that YOU are entirely responsible for PDPA compliance
Frontware is NOT liable for your data collection activities
You will use the Service only for lawful purposes
These Terms create a legally binding agreement between you and Frontware International Co., Ltd.
